NEWS: Games Workshop vs Curse.com

On March 31st, 2010, Games Workshop Limited filed suit against Curse, Inc over the trademark Warhammer Alliance and the use of the www.warhammeralliance.com URL in Maryland district court.

Warhammer Alliance is one of the largest online communities for EA’s struggling Warhammer Online MMO.

The complaint, thirteen pages in length, alleges, among other things, that Curse et al have committed trademark infringement, cybersquatting, dilution, unfair and deceptive trade practices, and unfair competition.

One portion of the compaint states that:

“The domain name warhammeralliance.com and the mark WARHAMMER
ALLIANCE itself literally states and implies that Defendants and their business are in an “alliance” with Plaintiff and its products and services offered under the WARHAMMER Marks.”

Games Workshop has specifically asked for a trail by jury in this case, in the jurisdiction of Maryland, while the Curse defendants are based in California and Luxembourg. Further documentation of this case can be found here and here.
